1. Who We Are
MAGPIE.FIT is operated by Bart Magpie, offering personal training, online coaching, and tailored fitness services to clients in the UK and abroad.

2. Services Provided
MAGPIE.FIT offers:
- Personal Training (in-person and on-location).
- Online Coaching and Accountability.
- Custom Training Plans and Digital Programmes.
- Consultations (fitness, nutrition, or lifestyle).
Each service is individualised and designed based on your goals, experience, and provided information.
3. Eligibility
By purchasing or using any MAGPIE.FIT service, you confirm that:
- You are 18 years or older, or have parental consent.
- You are in good physical and mental health, or have obtained clearance from a medical professional to participate in physical activity.
- You understand that participation in any exercise programme involves inherent risks.
MAGPIE.FIT does not take responsibility for any injury, illness, or condition that occurs as a result of improper exercise execution, undisclosed health issues, or failure to follow given guidance.
4. Payments
- All prices are displayed in GBP (£) or your local currency and include applicable taxes.
- Payment is required in full at the time of purchase.
- Payments are securely processed via third-party providers (e.g. Stripe, PayPal, or WooCommerce).
- Your card details are never stored by MAGPIE.FIT.
If a payment fails or is reversed, services may be paused until the balance is cleared.
5. Refunds and Cancellations
All products and services provided by MAGPIE.FIT are custom and personalised.
As such, they are non-refundable, in accordance with the UK Consumer Contracts Regulations 2013.
- Training plans and digital programmes: Non-refundable once delivered.
- Coaching packages: Non-refundable once the first session or plan is provided.
- In-person sessions: Can be rescheduled with at least 24 hours’ notice. Late cancellations or no-shows will be charged in full.
6. Delivery of Digital Products
Once purchased, digital training plans or coaching materials will be delivered via email, client portal, or secure link within the agreed timeframe.
Delivery is considered complete once access has been provided.
You are responsible for ensuring that your email address and contact details are correct at the time of purchase.
7. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information regarding your health, fitness level, and goals.
- Inform MAGPIE.FIT immediately of any changes to your health or physical condition.
- Follow instructions and safety guidelines provided during sessions or in your training plan.
- Use your best judgment when performing exercises unsupervised.
MAGPIE.FIT is not liable for injury, damage, or loss resulting from misuse of information, failure to follow guidance, or engaging in unsafe training practices.
8. Scheduling and Availability
- Personal training sessions are booked based on mutual availability.
- Location options include The Gym, Ealing, private studios, or on-location sessions with travel fees as agreed.
- MAGPIE.FIT reserves the right to modify or reschedule sessions in exceptional circumstances (e.g. illness, emergencies, or facility closures).
- Private studios or any external training locations, including rental or access fees, must be covered by the client.
9. Intellectual Property
All materials provided by MAGPIE.FIT — including digital plans, PDFs, coaching resources, and website content — are protected by copyright.
You may not copy, reproduce, share, or resell any material without written permission.
Any unauthorised use may result in legal action.
10. Limitation of Liability
MAGPIE.FIT and its representatives will not be held liable for:
- Any injury, loss, or damage resulting from use of the information or participation in training sessions.
- Technical issues, website downtime, or communication delays beyond our control.
To the fullest extent permitted by law, our liability is limited to the total amount paid for the service purchased.
11. Privacy and Data Protection
Your privacy is important to us. We collect and process personal data in line with the UK GDPR and Data Protection Act 2018.

12. Termination of Service
MAGPIE.FIT reserves the right to terminate or refuse service if a client:
- Engages in disrespectful, abusive, or inappropriate behaviour.
- Repeatedly misses sessions or violates these Terms.
No refund will be issued in such cases.
13. Governing Law
These Terms & Conditions are governed by and interpreted in accordance with UK law, and any disputes shall be handled by the courts of England and Wales.
14. Updates to These Terms
MAGPIE.FIT may update these Terms from time to time to reflect changes in law or services.
